Types of Child Custody in Virginia
- Sole custody: In this type of custody, for legal and decision-making purposes, the custodial parent is the only parent. She or he has nearly all of the rights and all of the responsibilities concerning the child. In sole custody situations, the other parent often has visitation rights.
- Joint legal custody: Though the child may physically reside with one parent most of the time, both parents are responsible for the child's well-being and both have the right to make decisions about things like religion, school, dating and so forth under the joint legal custody heading. This arrangement will work best for parents who share similar values. Parents who have always argued over how to raise the kids may find this type of custody difficult.
- Joint physical custody: In the state ofVirginia, parents are allowed to share physical and custodial care of their children. The time may be split 50-50, or differently, depending on the specific situations of the parents.
Visitation Attorney
When a parent is not granted any type of formal custody, he or she may be allowed visitation rights. Whether these are supervised or not, it is important that the parent take the opportunity to stay close with his or her child.
