Defending the DUI

When defending your DUI charges, we first examine the traffic stop. If there were any violations of your constitutional rights, it may be possible to suppress any evidence gathered during the stop. It is important that the police demonstrate they had reasonable suspicion to stop your car. If they lack reasonable suspicion, the stop may have been illegal, and any evidence obtained during the stop may not be admissible in court.

You Have the Right to Remain Silent

If you have been pulled over on suspicion of drunk driving, you do not have any obligation to take the physical or breath tests that the officer requests you perform at your arrest/stop location. It is important that you provide them with your driver's license and then either determine to polity respond to the officer's questions or assert your right to remain silent and allow yourself to be taken in, if required. Once in custody, and under arrest for DUI, you will be obligated to take the breath or blood test that is required or you may be charged with a refusal. Optimally, if you are arrested, you should assert your right to an attorney and decline to answer any further questions.
